In 2009, Maryland enacted the Interstate Compact on Educational Opportunity for Military Children (Chapters 501 & 502, Acts of 2009). The Compact was activated in July 2008 when it was ratified by the tenth state. As of May 2012, the Compact has been ratified by 46 states, and the District of Columbia.

The Compact addresses transitional issues faced by the children of active-duty military personnel as they transfer from one school system to the next. The Compact provides for an Interstate Commission to draft and enforce rules and provide general oversight. Each member state is represented on the Interstate Commission and must create its own State Council.

Effective July 2009, Maryland joined the Interstate Commission on Educational Opportunity for Military Children (Chapters 501 & 502, Acts of 2009). To coordinate statewide participation and compliance with Commission activities, Maryland created a State Council in April 2010 (Executive Order 01.01.2010.09). The Council consists of those members appointed by the Governor, and three members who serve ex officio.

The Council is to develop and update a plan and recommendations that address issues confronting children of military families as they move from school to school. Such issues concern the transfer of records; sequence of courses; graduation requirements; extracurricular activities; starting age for kindergarten and first grade; immunization requirements; and power of custodial parents when parents are deployed.
